In these Terms & Conditions, “we”, “us”, “our” “the Venue” and “Luddenham Raceway” refers to Hutland Pty Ltd Trading as Luddenham Raceway, ABN 96 157 974 199
Hutland Pty Ltd Trading as Luddenham Raceway, ABN 96 157 974 199 operates www.luddenhamraceway.com (the “website”) to provide online access to information on the products, activities and recreational services offered by Luddenham Raceway operating at 823 – 849 Luddenham Road, Luddenham (“the Premises”). The Premises include the Go Kart Centre, Motorsport Park, Skid Pan, pit areas, garages, access roads, parking areas, spectator areas and every other area occupied or controlled by Hutland Pty Ltd t/a Luddenham Raceway.
Your access to, and use of all the information on the website, the products, activities and recreational services made available to you through the website, and individual participants use of the facilities, equipment, and recreational services provided at the premises and its surrounds is provided subject to the following Terms & Conditions.
We reserve the right to amend this Notice at any time and your use of the website following any amendments will represent your agreement to be bound by these Terms & Conditions as amended. We therefore recommend that each time you access our website you read these Terms & Conditions.
By accessing browsing and using the website, registering, booking or making a purchase online or in person, you indicate that you have read, understood and agree:
i. To all Terms & Conditions, including the clauses, subclauses, and provisions outlined herein.
ii. Your continued use of the website constitutes an Agreement between you and Hutland Pty Ltd Trading As Luddenham Raceway, ABN 96 157 974 199 to abide and be bound by these Terms & Conditions;
iii. That the equipment, services and facilities provided by Luddenham Raceway are to be used in accordance with the rules and conditions displayed throughout the premises and these Terms & Conditions.
If you do not understand, or do not agree to all of the provisions contained in these Terms & Conditions, please close and exit all open pages from www.luddenhamraceway.com and do not visit the premises.
1. General Information
1.1 Operator Details
Hutland Pty Ltd (ABN 96 157 974 199), trading as Luddenham Raceway (“Luddenham Raceway”), operates the facilities located at 823–849 Luddenham Road, Luddenham, NSW 2745
1.2 Website Usage
The Luddenham Raceway website (www.luddenhamraceway.com) is provided for browsing, booking, purchasing services, and accessing information about our venue, offerings, activities and events.
1.3 Agreement to Terms
By accessing the website, placing an order, making a booking, or attending the venue, you agree to comply with these Terms and Conditions, including any additional conditions displayed onsite or provided in writing.
2. Bookings and Orders
2.1 Eligibility and Availability
Online bookings and purchases must be made by persons over the age of eighteen (18) years. By proceeding with a booking, you warrant that you are over 18 years of age.
We endeavour to ensure that our products and activities available for purchase and booking online are current, however we give no undertaking as to the availability of any product or activity advertised on our website.
In circumstances where Luddenham Raceway encounters unforeseen technical issues, or delays with our booking schedule, your activity session start time may begin or end later than the original start time and finish requested at the time of booking. Such a circumstance would not entitle you to a refund, and instead your start and or finish time would be adjusted to accommodate the booking request.
2.2 Booking Process
You may place orders or make bookings through our website or in writing with Luddenham Raceway representatives.
All bookings and orders constitute an offer to purchase services at the advertised price, inclusive of taxes and any applicable booking fees.
All prices are in Australian Dollars (AUD) and are inclusive of GST. Our prices are available on our website and we reserve the right to amend our prices at any time.
When you order from us, we require you to provide personal details such as but not limited to your name, email address, telephone contact and credit card details. We undertake to take due care with this information; however in providing us with such information you accept that we are not liable for its misuse due to error in transmission or virus or malware.
2.3 Booking Fees
Online bookings may be subject to non-refundable service and booking fees. By proceeding, you acknowledge and accept these additional charges.
2.4 No Cancellations Policy
Once a booking or order has been submitted, cancellations or changes are not permitted, even if confirmation is pending, except as required under Australian Consumer Law.
2.5 Group Bookings
To guarantee participation together, group members must be booked under a single transaction. Luddenham Raceway cannot guarantee the same time slots for individual bookings made separately.
2.6 Accepted Payment Methods
We accept Mastercard and VISA, and other methods as available through our online payment processing platform.
Cash is also an accepted payment method at the Venue when paying in person.2.7 Acceptance or Rejection or Cancellation of a Booking and or Order
Luddenham Raceway reserve the right to accept or reject your Booking and or Order, for any reason including if the requested Product and or Time Slot and or Date is not available, if there is an error in the Price or Product Description posted on the Site or an error in your Order and or Booking and or if the person who has made a booking has been previously banned from the Venue.
If Luddenham Raceway rejects and or cancels the Order and or Booking placed through the Site, confirmation of same will be provided as soon as practicable and no compensation would be payable in the event of rejection or cancellation of a booking and or order.
3. Conditions of Entry
3.1 Identification
All persons must upon entry, identify themselves at reception and provide valid government-issued photo identification when requested (acceptable forms are a Valid Australian Drivers Licence, Valid Australian Photo Identification Card and Valid Passport for Overseas Visitors).
Failure to present one of the above forms of valid identification when requested will result in the entry and the service being denied and a refund would not be applicable in such circumstances.
All persons who have used a credit card to make a payment online, will be asked to present the physical card for verification purposes. Failure to present the physical card will result in entry and the service being denied and a refund would not be applicable in such circumstances.3.2 Valid Purpose
Entry to the Venue is only permitted on a temporary basis for valid purposes, including participation, approved spectators, purchasing goods, or making genuine inquiries.
Entry will be denied and trespass action taken against anyone who attempts to enter the Venue without a valid purpose and in breach of the Terms and Conditions of the Venue.3.3 Compliance
Failure to comply with entry conditions, staff instructions, or venue rules will result in removal from the facility and/or a permanent ban and refunds will not be provided in the event that you are removed due to non-compliance.
3.4 Assorted
- Liquor may not be brought onto the premises without prior written consent from management, and must not be consumed before participating in any activities at the venue, all activities at the venue require a zero drug and alcohol level.
- Intoxicated persons will not be permitted entry to the premises and would not be entitled to a refund.
- Guests who are intoxicated, argumentative, quarrelsome, aggressive or disorderly will be removed from the Premises and would not be entitled to a refund.
- Smoking and/or Vaping is not permitted at the Venue.
- Professional, commercial, staged or organized photography or video recording is not permitted without prior authorisation.
- Tripods, lighting, other standalone ancillary photography or video equipment is not permitted.
- Any type of activity or item that may impact on other Guests safety or enjoyment whilst on the Premises is not permitted and if continues after being asked to cease will result in you being removed from the venue and you would not be entitled to a refund.
- The Premises is under 24-hour CCTV (with audio capabilities) surveillance for the safety and security of all visitors and staff. By entering, you consent to being recorded.
- All persons under 18 years of age must be accompanied by a parent or supervising adult at all times.
- Adults / Carers/ Legal Guardians are responsible for persons under their supervision.
- You must obey all reasonable verbal or written instructions / warnings given by Luddenham Raceway Karting Staff or you will be denied entry and will not be entitled to a refund.
- You must obey all signage and terms and conditions of Luddenham Raceway or you will be denied entry and service and will not be entitled to a refund.
- Appropriate clothing and footwear must be worn at all times or you will be denied a service and will not be entitled to a refund.
- You must be physically fit and health and not have a medical condition that would prohibit you from participating in activities offered by the Venue. In the event that is discovered that you attempted to mislead the venue and participate knowing that you were not fit to participate you would not be entitled to a refund. If you have any concerns about being medically fit to participate in an activity offered by the Venue, the onus is on the participant to seek medical advice and clearance from your doctor before you book and participate in an activity at the venue.
- Outside food and drink is not permitted at the venue. A Birthday cake may be permitted, however a clean-up fee would apply in the event of any mess or debris left behind.
3.4 Photography, Promotional and Advertising Material
Luddenham Raceway, on occasion, may take photographs of guests within the venue for a number of purposes not limited to but including:
- Mementos for groups and individuals conducting an event
ii. Display on in venue televisions and displays
iii. Training and development purposes.
By entering Luddenham Raceway you consent for us to take video and images for security and promotional purposes of yourself and, or any child/person you are responsible for.
Any photographs, videos or sound recordings taken by guests must be limited to their own attendees and are for personal enjoyment only and may not be used to portray the venue in a negative or defamatory light. Any use, reuse or production for commercial purposes without our express written consent is strictly prohibited.
By providing us with your email and/or phone number you consent to receiving promotional and advertising material from time to time. You may opt out from receiving this information at any stage.
3.5 Banning Notices
- In certain instances Banning Notices may be issued by Luddenham Raceway for the Premises, Venues and Facilities located at 823 – 849 Luddenham Road, Luddenham, NSW 2745.
- If you are issued with a Banning Notice, or are informed that you have been Banned from the Premises, Venue and Facilities located at the aforementioned address then you are no longer welcome at Luddenham Raceway and have a lifetime ban.
- Failure to abide by the Banning Notice will result in the Authorities being called and all punishment methods granted by the law will be utilised against you.
- Should you make a booking after being issued with a Ban and attempt to gain entry to the Venue, you will be denied entry, trespass action will be taken and you will not be entitled to a refund.
4. Participation Requirements
4.1 Registration and Acknowledgement of Risk
All participants must register via the links provided and acknowledge and accept the inherent risks associated with activities, and sign the required waivers or they will not be able to participate and will be denied entry.
4.2 Conduct
Participants must act with good judgment, must not disrupt the good order, management and harmony of the Venue and must obey all instructions and comply with all entry requirements and terms and conditions and use equipment responsibly.
4.3 Safety Equipment
All required safety equipment must be worn, either facility-issued or approved personal equipment whilst participating.
4.4 Attire
Participants must wear:
- Enclosed footwear such as sneakers or work boots (crocs, high heels, slides, thongs and slip on shoes are NOT permitted)
- Appropriate clothing:
- For Go Kart participants this means that long or short sleeve tops, long or short pants as and a helmet must be worn.
- For Track Day / Drifting / Skidpan and Powerskid participants, long sleeves and pants, a helmet and enclosed shoes must be worn. A properly fitted seatbelt or approved motorsport restraint must be worn at all times while a person is in a moving vehicle on the Skid Pan or the Motorsport Park.
- For Ride Day participants full leathers and a helmet must be worn.
- Long Hair must be tied up in a bun.
- Loose and flowing garments such as scarves (including headscarves), long dresses and long skirts are strictly prohibited whilst go karting as they pose an entanglement risk.
- Religious attire such as turbans and headscarves must not be worn if it would pose a threat to your safety whilst participating (e.g. helmet won’t fit over the helmet and or the headscarf may come loose if it has been wrapped and secured with a pin).
- Sun safety precautions should be taken such as using sunscreen and or covering up.
- In wet weather, go karting participants are recommend to bring wet weather gear or a change of clothes, or they may purchase wet suits from reception.
- Participants are warned that karts contain hot mechanical components, including engines and exhaust systems, which may cause burns. Participants must avoid contact with these components at all times and must ensure their clothing is worn and secured in a manner that does not create additional risk while operating or exiting a kart.
4.5 Intoxication Policy
Zero tolerance for alcohol or drugs. Intoxicated persons will be refused participation and removed from the premises without refund.
4.6 Minor Participation
Participants under 18 must have a parent or legal guardian present to sign consent forms and assume responsibility.
All participants must meet the minimum age requirements for the offerings of the Venue. Failure to comply with age requirements will not entitle you to a refund.
5. Additional Specific Activity Conditions
5.1 Go Karting
All participants must sign waivers, attend briefings, use designated equipment, and promptly report accidents or unsafe conditions before leaving the venue.
Confirmation Letters / Emails will contain the specifics of the requirements for the offering and are counted as part of the terms and conditions that impact the booking, please note this information will also be displayed and must be accepted before a booking can be made.All Go Kart Participants must be 14 and above to participate. Refunds will not be granted if an online booking is made for a go kart participant who does not comply with the minimum age, height, weight or waiver requirements.
5.2 Car, Skid Pan & Motorsport Park
All participants must sign waivers, attend briefings, promptly report accidents or unsafe conditions before leaving the venue and ensure their personal vehicles pass safety inspections prior to track access.
Confirmation Letters / Emails will contain the specifics of the requirements for the offering and are counted as part of the terms and conditions that impact the booking, please note this information will also be displayed and must be accepted before a booking can be made.
All persons inside the Motorsport Park must be 16 and above. There are no exceptions to this rule, and you will not be entitled to a refund if you breach this rule.
All drivers must hold at a minimum their red p’s. if you do not comply with this rule you will not be permitted to participate and will not be entitled to a refund.
- Refuelling
Vehicles must only refuel in the designated refuelling area or fines will apply. If fuel is spilled and damage is caused, then penalties will apply. - Spill Kit Clean Up Fee
- In the event that a Vehicle spills / leaks on track whilst at the Venue a Spill Kit clean up fee would apply, and payment for same would need to be made by the driver of the vehicle in full and cleared funds before the conclusion of the event, and before the vehicle may be removed from the Venue.
- Staff will not open or unlock the gates at the venue to allow the vehicle to be removed, until payment has been made in full and cleared funds for the spill kit clean up fee.
- Interest will compound daily at a rate of 8.5% until payment has been made in full and cleared funds, and debt recovery action will be taken, as well as action such as the placing of a caveat on the personal property of the driver to recover outstanding amounts and interest.
- If the owner of a vehicle refuses to make payment, and tries to obstruct access to entry and exit points and or position their vehicle in a manner that would prohibit entry / exit, then the owner would be removed from the venue and issued with a trespassing notice, and the vehicle would be moved by venue staff by whatever means necessary to permit entry / exit.
- The venue would not be liable for any damage caused during the moving of the vehicle, or while it is stored at the venue until payment has been made in full and cleared funds.
- Damage caused by a Vehicle whilst at the Venue
- In the event that a vehicle at the Venue causes damage whilst at the Venue, payment for any and all damages caused would need to be made by the driver in full and cleared funds before conclusion of the event, and before the vehicle may be removed from the Venue.
- Staff will not open or unlock gates to permit a vehicle to be removed until payment has been made in full and cleared funds.
- Interest will compound daily at a rate of 8.5% until payment has been made in full and cleared funds, and debt recovery action will be taken, as well as action such as the placing of a caveat on the personal property of the driver of the vehicle to recover outstanding amounts and interest.
- If the owner of a vehicle refuses to make payment, and tries to obstruct access to entry and exit points and or position their vehicle in a manner that would prohibit entry / exit, then the owner would be removed from the venue and issued with a trespassing notice, and the vehicle would be moved by venue staff by whatever means necessary to permit entry / exit.
- The venue would not be liable for any damage caused during the moving of the vehicle, or while it is stored at the venue until payment has been made in full and cleared funds.
- Entry Without Wristband to Motorsport Park
- All persons who have not visited reception and obtained permission and or a wristband from venue staff to be on site are considered to be trespassing at the venue.
- All persons who do not abide by the terms and conditions of entry and the instructions of staff on site, are trespassing.
- All persons who are trespassing will face trespass action which includes but is not limited to, Lifetime Bans, Authorities being called and enforcement action being taken,
- Out of Hours Access Fee
In the Event that a driver requires access out of hours (i.e. before an event has started or once it has finished), then an out of hours access fee would apply. Access Fee would start from $500.00. Out of Hours Access would not be granted until full and cleared funds have been received by the Venue for the Out of Hours Access Fee. - Tow Trucks
- Tow Trucks will only be permitted at the Venue at the discretion of Staff.
- Tow Trucks that have not been permitted by Staff will be seen to be trespassing and will not be granted access, and trespass action will be taken.
- Tow Trucks will only be permitted at such a time that they do not interfere with the safety or enjoyment of Staff and other Patrons on site.
- At all times, Tow Truck operators must follow all directions of staff, and abide by the terms and conditions of entry or they will not be permitted to remain on site.
- Approved Drifters Only
- Only Drifters who have applied for permission to the Venue, and subsequently received approval and be added to the approved drifters list, will be permitted to attend, participate in and book Luddenham Raceway Drift Days.
- Drifters must drive at an Intermediate or above level and demonstrate previous drifting history to be approved.
- If an unapproved Drifter attempts to gain entry they will be denied entry and will be removed and will not be entitled to a refund.
5.3 Ride Days
All participants must sign waivers, attend briefings, promptly report accidents or unsafe conditions before leaving the venue and ensure their personal vehicles pass safety inspections prior to track access.

All persons inside the Motorsport Park must be 16 and above. There is no exceptions to this rule, and you will not be entitled to a refund if you breach this rule.
All riders must hold at a minimum their red p’s. if you do not comply with this rule you will not be permitted to participate and will not be entitled to a refund.
For all ride days run by Luddenham Raceway, the following is required:
- All supermoto/motards motorcycles must have foot peg sliders. Luddenham Raceway strictly prohibits bikes to go on bike without sliders. These can be purchased on the day for $80.
- Full leathers (including longer length gloves and boots). Leathers can be a suit or zipped together.
- Full face helmet meeting approved standards
- Riders license (or demonstrate ability to ride a motorcycle).
- Chain adjusted correctly and lubricated
- No leaking fluids e.g. oil, coolant and brake fluid
- Tyres clear of any punctures and are deemed satisfactory for track.
- Steering head bearings adjusted correctly with no free play.
- Chain adjusted correctly and lubricated.
- Protected Engine Cover (Recommended)
- Handle bars is secured.
- Front and rear brakes are working to standard.
- Throttle action smooth and return freely to closed position.
- Front and rear pads deemed to be suitable.
- No sharp edges on clutch and front brake.
- Foot pegs on properly with no sharp edges.
- Refuelling
Vehicles must only refuel in the designated refuelling area or fines will apply. If fuel is spilled and damage is caused, then penalties will apply. - Spill Kit Clean Up Fee
- In the event that a Vehicle spills / leaks on track whilst at the Venue a Spill Kit clean up fee would apply, and payment for same would need to be made by the driver of the vehicle in full and cleared funds before the conclusion of the event, and before the vehicle may be removed from the Venue.
- Staff will not open or unlock the gates at the venue to allow the vehicle to be removed, until payment has been made in full and cleared funds for the spill kit clean up fee.
- Interest will compound daily at a rate of 8.5% until payment has been made in full and cleared funds, and debt recovery action will be taken, as well as action such as the placing of a caveat on the personal property of the driver to recover outstanding amounts and interest.
- If the owner of a vehicle refuses to make payment, and tries to obstruct access to entry and exit points and or position their vehicle in a manner that would prohibit entry / exit, then the owner would be removed from the venue and issued with a trespassing notice, and the vehicle would be moved by venue staff by whatever means necessary to permit entry / exit.
- The venue would not be liable for any damage caused during the moving of the vehicle, or while it is stored at the venue until payment has been made in full and cleared funds.
- Damage caused by a Vehicle whilst at the Venue
- In the event that a vehicle at the Venue causes damage whilst at the Venue, payment for any and all damages caused would need to be made by the driver in full and cleared funds before conclusion of the event, and before the vehicle may be removed from the Venue.
- Staff will not open or unlock gates to permit a vehicle to be removed until payment has been made in full and cleared funds.
- Interest will compound daily at a rate of 8.5% until payment has been made in full and cleared funds, and debt recovery action will be taken, as well as action such as the placing of a caveat on the personal property of the driver of the vehicle to recover outstanding amounts and interest.

- Entry Without Wristband to Motorsport Park
- All persons who have not visited reception and obtained permission and or a wristband from venue staff to be on site are considered to be trespassing at the venue.
- All persons who do not abide by the terms and conditions of entry and the instructions of staff on site, are trespassing.
- All persons who are trespassing will face trespass action which includes but is not limited to, Lifetime Bans, Authorities being called and enforcement action being taken,
- Out of Hours Access Fee
In the Event that a driver requires access out of hours (i.e. before an event has started or once it has finished), then an out of hours access fee would apply. Access Fee would start from $500.00. Out of Hours Access would not be granted until full and cleared funds have been received by the Venue for the Out of Hours Access Fee. - Tow Trucks
- Tow Trucks will only be permitted at the Venue at the discretion of Staff.
- Tow Trucks that have not been permitted by Staff will be seen to be trespassing and will not be granted access, and trespass action will be taken.
- Tow Trucks will only be permitted at such a time that they do not interfere with the safety or enjoyment of Staff and other Patrons on site.
At all times, Tow Truck operators must follow all directions of staff, and abide by the terms and conditions of entry or they will not be permitted to remain on site.
- Refuelling
6. Changes, Cancellations, and Refunds
6.1 Payment Terms
Full prepayment is required to secure bookings.
6.2 Refund Policy
- Bookings are available limited date and time basis, and you would not be entitled to a refund due to change of mind or later conflicts with the date selected, so please ensure that the booking is suitable for your intended date and purpose before it is made.
- Refunds are not provided for change of mind, personal circumstances, late arrivals, failure to attend or circumstances outside of the Venue’s Control such as Accidents, Crashes, Power Failures, Water Failures, Bushfires, Sudden Storms, Dangerous Weather, Extreme Weather, Sickness, Pandemics, Diseases, Viruses, Flooding, Earthquakes, Acts of Nature, Acts of God, Acts of Terrorism, War, Public Health Emergencies, Public Emergencies, and or any other act or occasion that would render Luddenham Raceway unable to operate, as it would be dangerous or unsafe to proceed (as determined by Luddenham Raceway / The Australian Government / Health Authorities or other ruling body).
- Refunds will not be granted for the following reasons:
- if the problem was outside of the control of Luddenham Raceway;
- if you insisted on having a service provided in a particular way, against the advice of Luddenham Raceway;
- if you failed to clearly explain your needs to the Operators at the Facility;
- if you hid, or failed to disclose a reason which affected your ability to participate, and subsequently lead to you being unable to continue being provided with a service;
- If you are prevented from continuing your sessions due to becoming unwell and or a companion becoming unwell.
- Missed Sessions.
- Disagreeing with the decision of Track Staff and or Pit Staff;
- If you are asked to leave, due to your behaviour and or if you are intoxicated;
- If you misuse the equipment and subsequently experience performance issues (i.e. double pedalling);
- Equipment malfunctioning due to wet weather conditions and or karts having to be changed (instead a replacement kart will be issued when Operators are notified about issues).
- Wait Times (instead a credit will be issued), please note that during peak trading periods wait periods at the Facility can be between 10 minutes – 9 hours, and if there is an accident on track or should any other unavoidable delay occur, the wait period previously estimated may lengthen without warning. This is a part of the experience and is something which cannot be helped;
- Other Participants (e.g. having other drivers in your race). Please note that when participating in an arrive and drive session you DO NOT get to choose who you are racing with and will be put with a range of individuals with varying skill levels, if you wish to avoid this then you will need to book a Group Event Package.
- Receiving a Black Flag in a Go Kart Session at the Facility. The flagging system is part of the racing experience and cannot be used as a reason to request or be entitled to receive a refund; and
- Go Kart Sessions being under a ‘Yellow Light’ at the Facility. The lightning system, and the subsequent restriction of speed is a part of the racing experience which is designed to ensure that Participants are kept safe whilst racing, and cannot be used as a reason to request or be entitled to a refund.
- If your Vehicle (Car and or Bike) is broken and thus not able to be driven on a Track / Drift / Ride Day .
6.3 Participant Rescheduling
- As all bookings are offered on a basis of limited time and availability, and provisions need to be made and resources expended so that Luddenham Raceway is in a position to accommodate a booking, NO changes will be permitted once a booking has been taken and payment made to secure the booking.
- As a gesture of goodwill, Luddenham Raceway may permit a participant to reschedule a booking, subject to availability and management discretion.
- Any changes to bookings such as those offered as a gesture of goodwill, will incur a rescheduling fee that will be advised by the venue and would be payable before the rescheduled event takes place.
- Venue Rescheduling Policy
- In the event that Luddenham Raceway may need to reschedule a booking due to circumstances outside of its control such as it being Dangerous and or Unsafe to operate and or Government / Regulatory Advice & or Unforeseen factors being present that prohibit Luddenham Raceway from being able to proceed as scheduled (reasons that may result in the Venue having to reschedule include, but are not limited to factors such as: Accidents, Crashes, Power Failures, Water Failures, Bushfires, Sudden Storms, Dangerous Weather, Extreme Weather, Sickness, Pandemics, Diseases, Viruses, Flooding, Earthquakes, Acts of Nature, Acts of God, Acts of Terrorism, War, Public Health Emergencies, Public Emergencies, and or any other act or occasion that would render Luddenham Raceway unable to operate, as it would be dangerous or unsafe to proceed as determined by Luddenham Raceway / The Australian Government / Health Authorities or other ruling body) the Event Organiser would be notified as soon as practicable & a Rebook Credit would be issued to the Event Organiser, the length of the rebook credit will vary depending on the package booked:
- Rebook Credit for Arrive and Drive Sessions are valid for 3 months (dated 3 months from the date of the original booking) & provide the Event Organiser with 3 months in which to rebook their event at a mutually convenient time. It is the sole responsibility of the Event Organiser to utilise their rebook credit before its expiry period, as lapsed credits cannot be extended.
- Rebook Credit for Group Bookings are valid for 6 months (dated 6 months from the date of the original booking) & provide the Event Organiser with 6 months in which to rebook their event at a mutually convenient time. It is the sole responsibility of the Event Organiser to utilise their rebook credit before its expiry period, as lapsed credits cannot be extended.
- Rebook Credit for Car Events are valid for 6 months (dated 6 months from the date of the original booking) & provide the Event Organiser with 6 months in which to rebook their event at a mutually convenient time. It is the sole responsibility of the Event Organiser to utilise their rebook credit before its expiry period, as lapsed credits cannot be extended.
- Rebook Credit for Bike Events are valid for 6 months (dated 6 months from the date of the original booking) & provide the Event Organiser with 6 months in which to rebook their event at a mutually convenient time. It is the sole responsibility of the Event Organiser to utilise their rebook credit before its expiry period, as lapsed credits cannot be extended.
- Rebook Credits issued due to Venue Rescheduling are valid as outlined above and are dated from the date of the original booking and must be redeemed by the event organiser inside the validity period provided to rebook the event at a mutually convenient time (i.e. rebooked event must take place on a date occurring before the expiry of the rebook period, so if your original booking took place on 2 Jan 25 and you had three months to reschedule, the rebook date must take place by 1 April 25 ). It is the sole responsibility of the Event Organiser to utilise their rebook credit before its expiry period, as lapsed credits cannot be extended.
- A Rebook Credit would only be issued for the original package, no changes are permitted to the original booking, the only exception would be to upgrade the package / increase number of Participants subject to availability, & in such a situation the Event Organiser would be responsible for any increase in cost.
- In the event a rebooked event cannot take place due to issues outside of the control of Luddenham Raceway, then an appropriate amount of time (as determined by Luddenham Raceway) would be granted to extend the rebook offer to accommodate the situation & allow additional time to in which to rebook.
- No refunds or compensation would be offered in the event that Luddenham Raceway is forced to reschedule and a rebook credit is provided, as Luddenham Raceway has incurred operating costs in expending resources to ensure that the booking can be accommodated.
- In the event that catering has been organised for an event, and Luddenham Raceway is forced to reschedule due to factors outside its control, Luddenham Raceway will do its best to make arrangements with the Caterer to reschedule the catering, however this may not always be possible as Catering is organised with a third party, and in such an instance where catering cannot be rescheduled, the Organiser would be instructed to attend the venue to collect the catering that has been ordered for an event that had to be rescheduled and in the event that the organiser is unable to attend, the catering would be donated to a nearby homeless shelter.
- In the event that a special go karting event, such as an enduro / go karting race series or one off go karting race night event needs to be rescheduled due to circumstances outside of Luddenham Raceway’s control (as noted above), a rebook credit would not be extended nor would a refund be offered, instead the special event would be rescheduled to another date as confirmed by Luddenham Raceway as the event was organised as a special event.
6.5 Weather Disruptions
- Events generally proceed in all weather conditions provided that Luddenham Raceway deems it safe to do so.
- In the case of unsafe operating conditions (e.g., extreme heat and extreme rain) as determined by Luddenham Raceway, events may be postponed at Luddenham Raceway’s discretion.
- No refunds are provided for weather-related postponements, instead as noted in the Venue Rescheduling Policy, the booking would be rescheduled.
- Extreme Heat
- Luddenham Raceway will only allow participation in activities provided that it is safe to do so.
- It is YOUR responsibility as a Participant to notify Staff immediately if you are feeling unwell or have experienced any heat related injuries and to take all care and precautions to avoid heat related injuries whilst participating.
- Heat related injuries include but are not limited to Heat Exhaustion, Heat Cramps, Heat Strokes, Sun Burn, Burns and or Blisters.
- If you are experiencing headaches, nausea, dizziness, weakness, irritability, thirst, and heavy sweating you may be suffering from a Heat Related Injury and you should consider your ability to participate.
- If Staff believe that you are unable to participate it is at their discretion to remove you from your event and they may call an ambulance for you, and you would be liable for any costs incurred.
- In the event that your event cannot proceed due to extreme weather conditions which would make it dangerous or unsafe to proceed as decided by Luddenham Raceway, you will be contacted and advised by Luddenham Raceway Staff, and their decision will be final, and the Standard Venue Rescheduling Policy outlined above would apply.
- Pandemic / Disease / Virus
- Participants acknowledge and understand that whilst being at the Venue and participating in activities there is a possibility that they may be exposed to potentially infectious, harmful and or deadly disease/s and or virus/s, despite all precautions being taken to limit such a possibility.
- Participants will not be entitled to a credit or a refund if they refuse to obtain and present a medical certificate clearing them for participation if requested by the Venue.
- Participants understand, acknowledge and accept that the number of people in the Venue may be limited, and agree to abide by any and all directives to enter and leave the Venue as directed by Venue Staff.
- Participants understand, acknowledge and accept that they will not be entitled to a credit or a refund if while at the Venue they refuse to abide by Venue Requirements and Government Requirements introduced to limit the spread and transmission of Pandemics and or Diseases and or Viruses.
- Participants understand, acknowledge and accept that in the event of a Pandemic normal delivery of services may be affected without warning and no credit or refund will be provided in the event that adjustments to service are required due to a Pandemic.
- In the event that Participants wish to request to reschedule a booking because they have been exposed to a potentially infectious / harmful and or deadly disease / virus, participants would need to provide proof of exposure of those impacted, and the Venue would be able to advise the applicable rescheduling fee to reschedule the event. Fee would be calculated based on the size of the booking / timing of the event and the amount of notice provided. Participants would not be eligible for a refund on the basis of exposure.
6.7 Late Arrivals
- It is the responsibility of Participants to arrive on time to ensure the Venue can deliver the package booked. Lateness means that participants cannot start on time result in avoidable delays.
- Participants acknowledge & understand late arrivals will result in penalties being applied such as, adjusted event format, reduced time, forfeited time or cancellation of event.
- No refunds, compensation, special allowances or additional time will be made for latecomers and latecomers may be denied entry to the Event due to lateness and missing important safety briefings, as it is the responsibility of Participants to arrive on time and to be prepared for their event.
- In the Event of Late Arrivals, Luddenham Raceway reserve the right to send out other bookings to ensure no further delays occur for the rest of the run schedule.
7. Liability and Indemnity
7.1 Acknowledgement of Risk
Participation in Luddenham Raceway activities involves inherent risks including serious injury or death. By participating, you voluntarily assume these risks.
7.2 Waiver of Liability
To the maximum extent permitted by law, Luddenham Raceway disclaims all liability for any injury, loss, or damage suffered by participants, spectators, or visitors.
7.3 Indemnity
You agree to indemnify Luddenham Raceway and its employees against any claims, demands, or expenses arising out of your actions, omissions, or breaches of these Terms.
Please read and acknowledge the information below as it applies to all individual participants:
RISK WARNING AND ACKNOWLEDGEMENT FOR ALL ACTIVITIES
IMPORTANT WARNING
WARNING: MOTORSPORT AND RECREATIONAL ACTIVITIES CONDUCTED AT LUDDENHAM RACEWAY ARE DANGEROUS. PARTICIPATION, ATTENDANCE AND ENTRY INTO ACTIVITY OR RESTRICTED AREAS MAY RESULT IN SERIOUS INJURY, PERMANENT DISABILITY OR DEATH.
This warning applies to every person entering the premises, including drivers, riders, go kart drivers, passengers, spectators, pit crew, photographers, videographers, contractors, private hirers, event organisers, external providers, guests and other attendees.
ACTIVITIES AND ROLES COVERED
By signing this document, I acknowledge, agree and declare that, in consideration of Luddenham Raceway allowing me, or a minor under my care, to enter the premises or access any facility, activity, service, vehicle, goods or equipment, I accept this Risk Warning and Acknowledgement.
This waiver applies to all activities conducted, supplied, permitted or authorised at Luddenham Raceway, including:
- Go karting;
- Car track days and drive days;
- Motorcycle track days and ride days;
- Racing, timed activities and competitive events;
- Practice, testing and vehicle development;
- Drifting, powersliding, burnouts and vehicle control activities;
- Skid Pan activities on dry, wet or artificially wetted surfaces;
- Driver and rider training;
- Passenger rides and demonstrations;
- Motorsport related filming, photography and media activities;
- Recovery, towing, pushing, loading, unloading and movement of vehicles;
- Private venue, track and Skid Pan hire;
- Corporate, promotional and organised events;
- Spectating and entering pit, paddock, staging, parking, event or other authorised areas; and
- Any other activity conducted, supplied, permitted or authorised at the premises.
This waiver applies regardless of the activity or role I initially intend to undertake. It continues to apply if I change activities or roles, participate in an additional activity, become a passenger, enter another authorised area or return during the period for which this waiver remains valid.
Signing this waiver does not automatically authorise participation in any activity. Before beginning each activity, I must obtain permission, meet the applicable eligibility requirements and complete any registration, briefing or safety process required by Luddenham Raceway.
If Luddenham Raceway introduces a materially different activity or identifies a materially different risk not reasonably covered by this warning, an additional warning, acknowledgement or waiver may be required.
COMPLIANCE WITH RULES AND DIRECTIONS
I agree that I, or a minor under my care, must:
- Read and comply with all signs, warnings, venue rules and information displayed or provided through the booking, registration, kiosk or waiver systems;
- Exercise due care and skill;
- Complete every registration and safety briefing required for the relevant activity;
- Follow every verbal, written, video, flag, light, signal or other direction given by Luddenham Raceway;
- Meet the applicable age, identification, height, weight, licence, experience and eligibility requirements;
- Wear and correctly use all mandatory clothing, helmets, footwear, restraints and safety equipment;
- Enter tracks, the Skid Pan, pits, staging areas and restricted areas only when expressly authorised;
- Obey every speed limit, track direction, pit procedure, staging procedure and passenger condition;
- Stop or leave an activity area immediately when shown a red flag or red light or given another stop direction;
- Not undertake any race, drift, burnout, doughnut, powerslide, tandem manoeuvre, wheelie, passenger ride or other manoeuvre unless authorised for that session;
- Not deliberately collide with another vehicle, barrier, object or person;
- Not behave recklessly, aggressively or in a manner that may endanger another person;
- Remove or properly secure loose objects before participating;
- Not participate while affected by alcohol, illicit drugs, medication, illness, injury, fatigue or another condition that may impair safe participation;
- Stop participating and notify Luddenham Raceway immediately if I become unwell, impaired, unsafe or unable to maintain reasonable control; and
- Ensure that a minor under my care understands and complies with every applicable rule and direction.
Failure to comply may result in participation being refused or terminated and removal from the premises without refund.
GENERAL RISKS APPLYING THROUGHOUT THE PREMISES
I understand and acknowledge that attendance and participation involve significant and obvious risks, including:
- Moving cars, motorcycles, go karts, recovery vehicles, trailers and equipment;
- Vehicles travelling at speed or moving in an unexpected direction;
- Sudden acceleration, braking, impact or change of direction;
- Loss of traction, balance, steering, braking or directional control;
- Collision with a vehicle, motorcycle, go kart, barrier, tyre wall, fence, building, equipment, fixed object, animal or person;
- Being struck by a vehicle, participant, component, stone, fluid or debris;
- A vehicle leaving the intended area, rolling over or becoming airborne;
- A driver, rider or passenger falling, being thrown or being ejected;
- Mechanical, electrical, tyre, wheel, steering, braking, restraint or equipment failure;
- Fire, explosion, smoke, fumes, fuel, oil, coolant or other fluid discharge;
- Contact with hot engines, exhausts, radiators, brakes and mechanical components;
- Loud noise, vibration, dust, glare, darkness and reduced visibility;
- Wet, slippery, uneven, gravel, contaminated or changing surfaces;
- Slips, trips and falls;
- Kerbs, bumps, potholes, rocks, branches and natural hazards;
- Heat, dehydration, exhaustion, reduced concentration and physical exertion;
- Unauthorised or accidental entry into an active or restricted area;
- Errors, unsafe conduct, negligence, lack of experience or loss of control by another person;
- Failure by another person to follow venue rules or safety directions;
- Delayed access to emergency assistance or medical treatment;
- Damage to or total loss of vehicles, motorcycles, equipment, clothing or other property;
- Serious physical or psychological injury;
- Permanent disability; and
- Death.
These risks may exist even where venue rules and safety directions are followed. They may arise suddenly and without warning from foreseeable or unforeseeable circumstances.
Safety briefings, supervision, protective equipment, barriers, venue rules and operating procedures may reduce risks but cannot eliminate every risk.
GO KARTING RISKS
Go karting involves particular risks including:
- Collision with another go kart, barrier, tyre wall, fence, equipment, structure or person;
- Sudden acceleration, braking, impact or change in direction;
- Spinning, skidding, leaving the track or travelling in an unintended direction;
- A go kart mounting another go kart or barrier, overturning or becoming airborne;
- Engine, throttle, brake, steering, tyre, wheel, seat or restraint failure;
- Being struck by another go kart, loose object or debris;
- Hair, clothing, jewellery or another item becoming caught or entangled;
- Burns from an engine, exhaust, brake or other hot component;
- Injury while entering or exiting a go kart;
- Impact or vibration affecting the head, neck, back, ribs, arms, hands, legs or feet; and
- Differences in participant speed, size, experience, judgement and ability.
CAR AND MOTORSPORT PARK RISKS
Car and Motorsport Park activities involve particular risks including:
- Vehicles travelling at high speed;
- Collision with another vehicle, barrier, tyre wall, fence, building, equipment, fixed object or person;
- Loss of steering, braking, traction or directional control;
- A vehicle spinning, leaving the track, rolling over or becoming airborne;
- Driver error, misjudgement, delayed reaction or loss of control;
- Engine, throttle, brake, steering, suspension, tyre, wheel, seatbelt, harness or restraint failure;
- Fire, explosion, electric shock or fuel or fluid discharge;
- Loose objects, shattered glass, detached components and flying debris;
- Reduced visibility caused by weather, smoke, spray, dust, glare, darkness or other vehicles;
- Injury while entering or exiting a vehicle or while present in a pit, staging or recovery area; and
- Damage to or total loss of a vehicle, equipment or other property.
MOTORCYCLE RISKS
Motorcycle activities involve particular risks including:
- Falling, sliding or being thrown from a motorcycle;
- Collision with another motorcycle, vehicle, rider, barrier, tyre wall, fence, equipment, fixed object or person;
- Being struck by another motorcycle, rider, vehicle, component or debris;
- Loss of balance, traction, steering, braking or control;
- A motorcycle leaving the track, sliding, overturning or becoming airborne;
- Engine, throttle, brake, steering, suspension, tyre, wheel, chain or equipment failure;
- Gravel, kerbs, uneven surfaces, fluids, debris and changing track conditions;
- Road or track rash, burns, fractures, crush injuries, head injuries and spinal injuries;
- Failure, incorrect fitting or limitations of helmets, leathers, boots, gloves or other protective equipment;
- Injury while mounting, dismounting, pushing, loading, unloading or recovering a motorcycle;
- Heat, dehydration, exhaustion and reduced concentration; and
- Differences in rider speed, skill, experience, judgement and ability.
DRIFTING AND POWERSLIDING RISKS
I acknowledge that drifting and powersliding deliberately involve reduced tyre traction and vehicle control.
The particular risks include:
- Intentional or unexpected loss of traction;
- Sliding, spinning, fishtailing and sudden changes in speed or direction;
- A vehicle travelling sideways, backwards or in an unexpected direction;
- Collision during solo, tandem, demonstration or passenger activities;
- A vehicle leaving the designated course, striking a barrier, rolling over or becoming airborne;
- Reduced visibility caused by tyre smoke, dust, spray, weather, darkness or other vehicles;
- Tyre failure, delamination, wheel failure or detached components;
- Engine, driveline, steering, suspension, brake or other mechanical failure;
- Fire, explosion, fuel or fluid discharge and contact with hot components;
- Injury caused by loose objects, shattered glass or flying debris;
- Close proximity between vehicles during tandem or passenger activities; and
- Damage to or total loss of a vehicle or other property.
SKID PAN RISKS
Skid Pan activities may include driver training, vehicle control exercises, drifting, powersliding, skidding, demonstrations, filming and vehicle testing on dry, wet or artificially wetted surfaces.
The particular risks include:
- Intentional or unexpected loss of traction;
- Skidding, spinning, fishtailing, sliding, drifting and aquaplaning;
- Sudden changes in surface grip, vehicle behaviour or direction;
- Loss or reduction of steering, braking or directional control;
- Collision with another vehicle, barrier, fence, building, equipment, fixed object or person;
- A vehicle leaving the intended driving area, rolling over or becoming airborne;
- Changing grip caused by water depth, water distribution, tyre condition, temperature, weather or previous vehicle activity;
- Water, oil, fuel, coolant, debris or another substance affecting traction or control;
- Reduced visibility caused by water spray, smoke, weather, darkness or other vehicles;
- Mechanical, tyre, wheel, steering, brake, suspension or restraint failure; and
- Injury during staging, recovery, towing or vehicle movement.
I specifically acknowledge that loss or reduction of tyre traction, sudden changes in direction and reduced vehicle control are intended and inherent features of Skid Pan activities.
FILMING, PHOTOGRAPHY AND MEDIA RISKS
Filming, photography and media activities involve particular risks including:
- Being struck by a moving car, motorcycle, go kart, recovery vehicle, equipment or debris;
- Working near an active track, Skid Pan, pit, staging, parking or recovery area;
- Reduced awareness while concentrating on a camera, subject or equipment;
- Slips, trips and falls caused by cables, tripods, lighting, wet surfaces, uneven ground or equipment;
- Injury while carrying, positioning, installing or removing cameras, lighting, mounts or production equipment;
- Failure, collapse or movement of a camera mount, drone, rigging or other equipment;
- Distracting a driver, rider, participant or other person;
- Injury or damage caused by unauthorised positioning or movement;
- Wind, rain, heat, poor visibility and other weather conditions; and
- Damage to or loss of cameras, drones and production equipment.
Possession of a camera, media pass or approval to film does not authorise entry onto an active track, Skid Pan or other restricted area. Separate express permission is required.
PRIVATE HIRE AND ORGANISED EVENT RISKS
Private hire, corporate activities and organised events may involve risks arising from:
- Activities selected, organised or controlled by a hirer or event organiser;
- Conduct of participants, staff, contractors, external providers, invitees and spectators;
- Differences in participant experience, competence, fitness and ability;
- Participant supplied vehicles, equipment, structures, signs or facilities;
- Temporary structures, marquees, displays, electrical equipment, cables and event infrastructure;
- Movement of vehicles within parking, paddock, pit, staging and restricted areas;
- Unauthorised access, overcrowding or persons entering unsafe areas;
- Catering, waste, spills and other substances creating slip, contamination or hygiene hazards;
- Weather, heat, wind, rain, lightning, fire and emergency evacuation; and
- Injury or damage caused by an external provider, contractor, exhibitor, participant or guest.
Nothing in this waiver removes any separate obligation imposed on a private hirer, organiser, contractor or external provider under a hire agreement, event agreement, licence, insurance requirement or applicable law.
PARTICIPANT SUPPLIED VEHICLES AND EQUIPMENT
Where I use a car, motorcycle, helmet, protective clothing or equipment owned, controlled or supplied by me or another participant, I warrant that it is properly maintained, safe and suitable for the proposed activity.
The driver, rider and owner are responsible for ensuring that the vehicle:
- Is mechanically sound and suitable for the activity;
- Has effective steering, brakes, tyres, wheels, suspension and controls;
- Has wheel fasteners and safety critical components correctly installed and secured;
- Has suitable seats, seatbelts, harnesses and restraints where applicable;
- Has no dangerous fuel, oil, coolant, brake fluid or other fluid leak;
- Has its battery, bonnet, boot, doors, fairings, bodywork and other components properly secured;
- Contains no loose or unsecured objects;
- Meets every noise, inspection, safety and operating requirement imposed by Luddenham Raceway; and
- Is not used where a defect, damage or condition may make participation unsafe.
Any inspection, observation or scrutineering undertaken by Luddenham Raceway is limited and does not certify or guarantee that a vehicle or equipment is safe, roadworthy, mechanically sound or suitable for participation.
Responsibility for participant supplied vehicles and equipment remains with the driver, rider and owner.
Luddenham Raceway may refuse or terminate participation where a participant, vehicle or equipment appears unsafe, unsuitable, excessively noisy or likely to cause injury or damage.
No refund is payable where participation is refused or terminated because a participant, vehicle or equipment does not comply with the applicable requirements.
MEDICAL CONDITIONS AND FITNESS
I acknowledge that participation requires physical fitness, coordination, judgement, skill and mental alertness.
Luddenham Raceway has not represented or guaranteed that I, or a minor under my care, possess the skill, fitness, experience or capacity required to participate safely.
I must disclose before participating any medical, physical, intellectual, psychological or other condition that may affect my ability, or the ability of a minor under my care, to participate safely.
I acknowledge that participation may cause the contraction, aggravation, acceleration or recurrence of an injury, disease, medical condition or psychological condition.
I am responsible for deciding whether I, or a minor under my care, are sufficiently fit and capable to participate and for obtaining medical advice where necessary.
ALCOHOL, DRUGS AND IMPAIRMENT
Participation is prohibited where a person has consumed alcohol or illicit drugs or is affected by medication, illness, injury, fatigue or another condition that may impair judgement, coordination, balance, reaction time or safe participation.
I warrant that neither I nor a minor under my care will participate while affected by any such substance or condition.
POSSIBLE INJURIES AND CONSEQUENCES
I acknowledge that attendance and participation may result in:
- Bruising, cuts, scrapes, abrasions, gravel rash, splinters, burns, blisters and heat related injuries;
- Sprains, strains, tears and injuries to muscles, tendons or ligaments;
- Fractures and broken bones;
- Crush injuries, strangulation and impalement;
- Eye injury, blindness and loss of teeth;
- Head, brain, neck, back and spinal injuries;
- Internal injuries;
- Partial or total paralysis;
- Loss of limbs or other body parts;
- Contraction, aggravation, acceleration or recurrence of disease or illness;
- Psychological injury or trauma;
- Heart attack, heat stroke or aggravation of an existing condition;
- Permanent disability;
- Economic loss;
- Death; and
- Injury or disadvantage that may not presently be known or foreseeable.
PROPERTY AND INSURANCE
Luddenham Raceway does not provide insurance for:
- Personal injury or death;
- Vehicles, motorcycles, equipment or other property;
- Mechanical failure;
- Collision or accident damage; or
- Liability for injury or damage caused to another person or their property.
I understand that registration, compulsory third party insurance, comprehensive vehicle insurance and ordinary road insurance may not cover go karting, track use, motorcycle activities, drifting, Skid Pan activities or other motorsport activities.
I am responsible for obtaining independent insurance advice and arranging appropriate insurance before participating.
I accept the risk of damage to or total loss of my vehicle, motorcycle, equipment, clothing and other property.
To the fullest extent permitted by law, Luddenham Raceway is not responsible for loss, theft or damage to unattended personal belongings or valuables brought onto the premises. Each person is responsible for securing their own property.
VOLUNTARY ASSUMPTION OF RISK
By entering the premises or participating in any capacity, I acknowledge and agree that:
- I have read and understood this Risk Warning and Acknowledgement;
- I understand the general risks and the risks associated with every activity or role I may undertake;
- Motorsport and recreational activities at Luddenham Raceway are dangerous and potentially life threatening;
- The risks may be caused by my actions, the actions or negligence of other participants or persons, accidents, equipment failure, weather, natural forces or other foreseeable or unforeseeable causes;
- I voluntarily accept and assume all inherent, obvious and other risks associated with entry, attendance and participation;
- I accept the risk of serious injury, permanent disability, death, property damage and economic loss;
- I am responsible for assessing my fitness, skill, experience and ability before participating;
- I am responsible for complying with the requirements of each activity I undertake;
- I am responsible for the condition and suitability of participant supplied vehicles and equipment;
- I will stop participating if I feel unsafe, unwell, impaired or unable to maintain reasonable control; and
- I voluntarily participate, or permit a minor under my care to participate, at my own risk and despite the risks identified in this warning.
RESPONSIBILITY FOR DAMAGE
I accept responsibility for reasonable loss, damage and clean up costs caused by me, a minor under my care, or a vehicle or equipment under my ownership or control, including damage to:
- Tracks and the Skid Pan surface;
- Barriers, tyre walls and fences;
- Buildings, garages and pit facilities;
- Timing, lighting, water and safety equipment;
- Recovery vehicles and equipment;
- Other equipment, vehicles or property; and
- Any other part of the premises.
This responsibility does not apply to the extent that the loss was caused by Luddenham Raceway or where responsibility cannot lawfully be imposed upon me.
RECOVERY AND EMERGENCY INTERVENTION
If a car or go kart becomes disabled, the driver and passenger must remain inside with their restraints fastened unless there is immediate danger or Luddenham Raceway directs them to exit.
If a motorcycle or rider becomes disabled or falls, the rider must follow the applicable safety briefing and directions. A rider must not cross an active track or place themselves in the path of another vehicle.
Participants must keep clear of a disabled vehicle, fallen rider or incident area unless authorised to assist.
I authorise Luddenham Raceway to move, push, lift, tow or recover a vehicle, motorcycle, go kart or equipment where reasonably required for safety or venue operations.
I accept the ordinary risks associated with recovery and agree to pay applicable recovery, towing, clean up or damage costs.
To the fullest extent permitted by law, Luddenham Raceway is not responsible for pre-existing defects, mechanical failure, weaknesses in the vehicle or equipment, or unavoidable damage arising from a recovery operation undertaken with reasonable care.
RELEASE
To the fullest extent permitted by law, I release and discharge Hutland Pty Ltd t/a Luddenham Raceway and its related entities, shareholders, directors, officers, employees, contractors, officials, volunteers and agents from claims, rights, causes of action, demands, losses, damages, costs or liabilities arising from or connected with:
- My entry into or presence at the premises;
- My participation or the participation of a minor under my care;
- My use of any facility, activity, vehicle or equipment;
- Personal or psychological injury;
- Disease or illness;
- Death;
- Property loss or damage; and
- Economic loss,
including where a claim arises from a negligent act or omission of a released party, except to the extent that liability cannot lawfully be excluded, restricted or modified.
This release is intended to bind me and, to the extent permitted by law, my heirs, estate, executors, administrators, successors and legal personal representatives.
STATUTORY RISK WARNING
I acknowledge and agree that this section constitutes a “risk warning” for the purposes of section 5M of the Civil Liability Act 2002 (NSW) and any other applicable legislation.
This warning applies to the general and particular risks associated with entering, attending and participating in any recreational or motorsport activity conducted, supplied, permitted or authorised at Luddenham Raceway.
INDEMNITY
To the fullest extent permitted by law, I indemnify and agree to keep indemnified Hutland Pty Ltd t/a Luddenham Raceway and its related entities, shareholders, directors, officers, employees, contractors, officials, volunteers and agents against third party claims, property damage, liabilities, losses and reasonable legal costs arising from or connected with:
- My negligent, reckless, unlawful or deliberate act or omission;
- The negligent, reckless, unlawful or deliberate act or omission of a minor under my care;
- My failure, or the failure of a minor under my care, to follow venue rules, safety requirements or directions;
- My breach of this waiver; or
- Injury, loss or damage caused by me, a minor under my care, or a vehicle or equipment under my control.
This indemnity does not apply to the extent that the relevant loss was caused by Luddenham Raceway or where the indemnity would be unlawful or unenforceable.
FIRST AID AND EMERGENCY TREATMENT
I authorise Luddenham Raceway and its employees, contractors or agents to arrange or administer first aid and seek ambulance, medical or emergency assistance for me, or a minor under my care, where they reasonably consider it necessary.
I agree to pay ambulance, hospital, medical and associated expenses incurred on my behalf or on behalf of a minor under my care.
To the fullest extent permitted by law, I release Luddenham Raceway from liability arising from first aid or emergency assistance provided in good faith, except to the extent that liability cannot lawfully be excluded.
PHOTOGRAPHY AND VIDEO CONSENT
I consent to Luddenham Raceway taking photographs or video recordings in which I may appear and using or distributing that material through print, digital, online, social media or other promotional channels.
I understand that I will not receive payment or other remuneration for the authorised use of this material.
If I do not consent, I must notify Luddenham Raceway in writing before entering or participating so that reasonable steps may be considered.
WARNING UNDER THE AUSTRALIAN CONSUMER LAW
Under the Australian Consumer Law, statutory guarantees may apply to the supply of certain goods and services. These guarantees include that services will:
- Be rendered with due care and skill;
- Be reasonably fit for a purpose made known to the supplier; and
- Be reasonably expected to achieve a result made known to the supplier.
Section 139A of the Competition and Consumer Act 2010 (Cth) permits a supplier of recreational services to ask a person to agree that certain statutory guarantees do not apply to that person, or to a person on whose behalf the services are acquired.
By signing this document, I acknowledge and agree that, to the fullest extent permitted by law, the liability of Hutland Pty Ltd t/a Luddenham Raceway arising from the supply of recreational services or recreational activities is excluded in relation to:
- Death;
- Physical or mental injury, including the aggravation, acceleration or recurrence of an injury;
- The contraction, aggravation or acceleration of a disease;
- The coming into existence, aggravation, acceleration or recurrence of any other condition, circumstance, occurrence, activity, form of behaviour, course of conduct or state of affairs that is or may be harmful or disadvantageous to me or the community; and
- Any condition, circumstance, occurrence, activity, behaviour, conduct or state of affairs that may result in harm or disadvantage to me or the community.
To the fullest extent permitted by law, I waive and release Luddenham Raceway, its related entities, employees and agents from any claim, right or cause of action arising from or connected with death, physical or mental injury, disease, property loss or damage, or economic loss suffered in the course of, consequential upon or incidental to participation in the activities, including where caused by negligence, except where liability cannot lawfully be excluded.
I understand that I am not required to accept these exclusions and releases. However, Luddenham Raceway may refuse to permit entry or participation or refuse to supply the relevant recreational services if I do not accept them.
LIMITATIONS ON EXCLUSIONS
Nothing in this waiver excludes, restricts or modifies any consumer guarantee, statutory duty, right or liability that cannot lawfully be excluded, restricted or modified.
Every exclusion, release, assumption of risk and indemnity in this waiver operates only to the fullest extent permitted by law.
No provision is intended to exclude liability where an exclusion is prohibited under section 139A of the Competition and Consumer Act 2010 (Cth), the Australian Consumer Law, the Civil Liability Act 2002 (NSW) or any other applicable legislation.
FINAL ACKNOWLEDGEMENT
By signing this waiver, I confirm and agree that:
- All information I have provided is truthful, accurate and complete;
- I, or a minor under my care, must meet every applicable age, identification, height, weight, licence, clothing, supervision and eligibility requirement;
- Signing this waiver does not guarantee eligibility, entry or permission to participate in any activity;
- No refund is payable where participation is refused because I, or a minor under my care, do not satisfy the disclosed eligibility, safety, clothing or participation requirements;
- I have read and understood this waiver, including the Risk Warning and Acknowledgement and Warning Under the Australian Consumer Law;
- I understand that this waiver applies to every activity or role I may undertake, including an activity or role selected after signing;
- Before beginning any new or additional activity, I must obtain permission, complete the applicable registration and briefing and comply with that activity’s rules;
- I have had a reasonable opportunity to read this waiver and ask questions;
- I enter into this agreement freely and voluntarily;
- I consent to my participation, or the participation of a minor under my care, subject to Luddenham Raceway’s approval;
- I will comply with the conditions of entry and will not disrupt the safe or orderly operation of the premises;
- Inappropriate, abusive, aggressive, antisocial, unsafe or noncompliant conduct may result in participation being refused or terminated, removal from the premises and further entry being prohibited;
- I acknowledge and agree that if I, or a minor under my care, engage in any form of online harassment against Luddenham Raceway, including but not limited to “review bombing” or any coordinated, false, misleading, or malicious online posts, comments, or reviews, such conduct will be deemed unacceptable, disruptive, and harmful to the business and reputation of Luddenham Raceway. In such circumstances, Luddenham Raceway reserves the right to impose a lifetime ban from the premises and pursue legal action without further notice. This may include claims for damages, injunctive relief, and any other appropriate legal remedies. I further acknowledge that I may be held personally liable for all costs, including legal fees, incurred by Luddenham Raceway in enforcing its rights.
- This agreement is governed by the laws of New South Wales, Australia; and
- If a provision is invalid, unlawful or unenforceable, it will be read down to the extent necessary or severed, and the remaining provisions will continue to operate.
PARTICIPANTS UNDER 18 YEARS OF AGE
As the participant’s parent or legal guardian, I:
- Confirm that I have legal authority to complete this waiver for the participant;
- Consent to the participant entering the premises and participating in activities authorised by Luddenham Raceway;
- Confirm that I have explained, in a manner appropriate to the participant’s age and understanding, the nature and dangers of the activities, the applicable risks and the importance of following all rules and directions;
- Confirm that the participant has been given an opportunity to read and understand the terms that apply to them;
- Accept responsibility for disclosing any medical, physical, intellectual, psychological or other condition that may affect the participant’s ability to participate safely;
- Agree to ensure that the participant complies with all applicable age, clothing, safety, supervision and conduct requirements; and
- Confirm that both the participant and I understand that Luddenham Raceway may refuse or terminate participation where it considers participation unsafe or any applicable requirement has not been satisfied.
8. Venue Policies
8.1 Photography and Filming
Commercial photography or recording requires prior written approval from Luddenham Raceway management and cannot portray the venue in a negative or defamatory light.
Go-Karting participants may bring a GoPro or similar action camera to record their experience, provided they use their own mount and securely attach the camera to the kart only. Participants understand that the use of such devices is at their own risk, and the Venue bears no responsibility in the event that equipment becomes damaged or lost if used at the venue.
8.2 Smoking Policy
Smoking (Vaping or Cigarettes) is prohibited across the venue. Breaches may incur fines up to $500 and/or additional cleanup fees.
8.3 Refuelling Policy
Refuelling in the Motorsport Park is only permitted in designated areas. Violations may incur fines of up to $10,000 and participants will be liable for resulting damage.
8.4 Cleanliness
Visitors must maintain venue cleanliness. Failure to do so may result in cleaning fees up to $500.
8.5 Behaviour
Anti-Social, abusive, aggressive, violent, threatening, disruptive and or unruly behaviour will result in immediate removal and will lead to permanent banning from the venue.
8.6 Damages
- The Venue takes no responsibility for any personal items that may become lost, stolen or damaged whilst at the Venue.
- Damages, Breakages & Clean Up Fees as well as any unpaid amounts must be paid before Participants leave the Venue or Debt Recovery Action will be taken against the Event Organiser, Company and Individuals responsible. Interest at the current pre-judgment interest rate of NSW would apply.
- Damage caused by a Vehicle whilst at the Venue
- In the event that a vehicle at the Venue causes damage whilst at the Venue, payment for any and all damages caused would need to be made by the driver in full and cleared funds before conclusion of the event, and before the vehicle may be removed from the Venue.
- Staff will not open or unlock gates to permit a vehicle to be removed until payment has been made in full and cleared funds.
- Interest will compound daily at a rate of 8.5% until payment has been made in full and cleared funds, and debt recovery action will be taken, as well as action such as the placing of a caveat on the personal property of the driver of the vehicle to recover outstanding amounts and interest.
- If the owner of a vehicle refuses to make payment, and tries to obstruct access to entry and exit points and or position their vehicle in a manner that would prohibit entry / exit, then the owner would be removed from the venue and issued with a trespassing notice, and the vehicle would be moved by venue staff by whatever means necessary to permit entry / exit.
- The venue would not be liable for any damage caused during the moving of the vehicle, or while it is stored at the venue until payment has been made in full and cleared funds.
8.7 Gift Vouchers
- Hutland Pty Ltd T/A Luddenham Raceway (ABN 96 157 974 199) sells Gift Vouchers.
- Gift Vouchers are redeemable at Luddenham Raceway, located at 823 – 849 Luddenham Road Luddenham, NSW 2745, for the purpose of purchasing available Food, Drink, Merchandise and Services offered by Luddenham Raceway, up to the dollar amount listed on the Voucher. E.g. A $50.00 Voucher entitles the holder of the Voucher, as named on the Voucher, to redeem the Voucher for $50.00’s worth of available Food, Drink, Merchandise and services.
- All Gift Vouchers are valid for 36 months (3 Years) from the date of issue and cannot be extended under any circumstances.
- All Gift Vouchers are only redeemable for available Food, Drink, Merchandise and Services offered by Luddenham Raceway on the day of redemption, up to the dollar amount listed on the Voucher.
- Gift Vouchers must be physically presented when redeeming. Lost Gift Vouchers cannot be redeemed or replaced.
- Gift Vouchers cannot be redeemed for cash and any remaining amount on the Gift Voucher will not be returned as cash, instead a credit of the remaining amount and the expiry date will be made on your Luddenham Raceway Licence (Account). Your Licence must be valid to make notes, and redeem any remaining amounts.
- Gift Vouchers cannot be used to purchase Gift Vouchers.
- Gift Vouchers are non-transferable and must be redeemed solely by the person named on the Gift Voucher. Valid, Government Issue Photo Identification (Australian Drivers Licence, Australian Photo ID Card and Passport only) will be required to verify and redeem a Voucher.
- Holding a Gift Voucher does not guarantee you the provision of any Luddenham Raceway Goods and or Services and we strongly recommend calling 02 9834 2366 to check availability and avoid disappointment if you intend on redeeming a specific good or service with the Voucher.
- A Gift Voucher may be used to pay a portion / the whole amount of a deposit for a Group Event offered at Luddenham Raceway (such as a Mini Grand Prix, Grand Prix ), and will be subject to the same conditions of all deposits paid for group events in that it will be non-refundable in the event of cancellations or change of mind.
- You may not use your Gift Voucher to pre-book Arrive and Drive Go Kart sessions. Gift Vouchers may only be redeemed on the day, provided that there is availability in an Arrive and Drive Go Kart Session.
- The Entry Policy and Terms and Conditions of Luddenham Raceway must be observed and abided by when redeeming Gift Vouchers. Failure to do so will result in you being unable to redeem your Gift Voucher for certain Goods and or Services and you will not be offered compensation or a refund if this is the case.
- A Voucher cannot be refunded for Change of Mind. The onus of ensuring that the Voucher is suitable is on the Purchaser and the Purchaser must ensure that the recipient is aware of the Terms and Conditions of the Voucher if the Voucher is being given as a gift.
8.8 Online Harassment & Defamation
- Luddenham Raceway maintains a strict zero-tolerance policy regarding any form of online harassment. This includes, but is not limited to, “review bombing,” the publication of false or misleading reviews, defamatory statements, and coordinated or malicious online attacks intended to damage the reputation or operations of the venue.
- Any individual —who is found to be, or is reasonably suspected of being, involved in such conduct may be permanently banned from the premises. In addition, Luddenham Raceway reserves the right to pursue legal action without further notice under all applicable laws, including the Defamation Act 2005 (NSW), the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010), and the Criminal Code Act 1995 (Cth).
- Luddenham Raceway expressly reserves the right to seek monetary damages, injunctive relief, and any other appropriate legal remedies. Offending individuals may be held personally liable for all costs, including legal expenses, incurred in enforcing these rights.
8.9 Vehicle Storage, Fees, Lien and Access Conditions
- Any vehicle left, stored or abandoned on the premises without the prior written consent of the business will incur a storage fee of $110 per day per vehicle, calculated daily from the date the vehicle remains on site.
- Where a vehicle is left on the premises with or without consent, the owner and/or person responsible for the vehicle agrees to pay all applicable storage, access and related charges. Storage fees will continue to accrue daily until the vehicle is removed from the premises.
- The business retains a lien over any vehicle on the premises for all unpaid fees and charges. The vehicle will not be released until all outstanding amounts are paid in full and cleared funds are received.
- No person is permitted to enter the premises to access or recover any vehicle without prior approval. Any unauthorised entry will be treated as trespass and may be referred to NSW Police.
- To the fullest extent permitted by law, the business accepts no responsibility or liability for any loss, theft or damage to any vehicle or its contents, however caused, while on the premises.
- The business reserves all rights available at law in relation to unpaid fees, including but not limited to recovery action and the disposal of uncollected vehicles in accordance with applicable legislation.
9. Health and Safety
9.1 Fitness to Participate and Health Exclusions
- The activities offered by the venue (Go Karting / Track Days / Ride Days / Drift Days) are intense and potentially dangerous activities, and participants must ensure they are physically fit to take part. Individuals with health conditions that may impair their driving or make it unsafe to participate are NOT permitted to participate.
- Pregnant women and individuals with pre-existing health conditions that could affect their ability to drive are not allowed to participate.
- Customers with high blood pressure, heart conditions, or back/neck issues should seek medical clearance before participating.
- If you have any doubts about your ability to participate, you must seek medical clearance prior to you making a booking.
9.2 Accident Reporting
All injuries, incidents, or accidents that occur at the venue must be immediately reported to reception and documented before leaving the premises.
9.3 Hot Surface and Burn Risk Warning and Acknowledgment
Participants acknowledge and agree that motorsport and karting activities involve exposure to hot surfaces and components. Without limitation, this includes engines, exhaust systems, radiators, brake components, and other mechanical parts that may reach temperatures capable of causing serious burns.
Participants understand and accept that:
- Contact with a kart or its components may cause burns, heat related injuries, or clothing damage;
- Such risks may arise during driving, entering or exiting a kart, assisting others, or being in proximity to operating vehicles;
- Heat hazards may not always be visible or obvious; and
- These risks are inherent in the activity.
By participating, each participant:
- voluntarily assumes all risk of burns and heat related injury to the fullest extent permitted by law;
- releases and discharges Luddenham Raceway, its owners, officers, employees, contractors, and agents from any liability arising from burns or heat exposure, except where liability cannot be excluded under Australian law; and
- agrees to follow all safety directions regarding clothing, conduct, and handling of karts; and
- acknowledges responsibility for ensuring their clothing and footwear are suitable for motorsport activity.
Participants must not touch any engine, exhaust, radiator, brake, or other mechanical component of any kart or vehicle unless expressly directed by staff.
Participants must strictly follow all safety directions issued by staff, including directions to use protective equipment such as a heat shield where provided, and to immediately slow down, return to the pit area, and notify staff if they experience excessive heat or discomfort while operating a kart.
Failure to comply with any safety direction or instruction may result in immediate removal from the premises without refund and may result in suspension or permanent exclusion from future participation.

Participants must comply with all applicable laws, regulations, and safety instructions while onsite.
10.2 Governing Law
These Terms and Conditions are governed by the laws of New South Wales, Australia.
10.3 Waiver Requirement and Acceptance of Terms
All persons entering Luddenham Raceway or participating in any activity at the premises, including drivers, riders, passengers, spectators, private hirers, event organisers, media representatives, photographers, videographers, drone operators, contractors and guests, must complete the applicable waiver before entry or participation. To the fullest extent permitted by law, any person who enters the premises, purchases an entry ticket, makes a booking or participates in an activity without completing the waiver is deemed to have read, understood, accepted and agreed to be bound by its terms. 13. One Off Events and Collaborations
13.1 Application
This section applies to all one off events, special events, competitions, drift events, activations, and third party collaborations conducted at or by Luddenham Raceway (“Event”).
These Events are distinct from standard bookings and are subject to specific conditions due to their fixed nature, limited availability, and event specific requirements.13.2 Eligibility Requirements (Age and Licence)
(a) Only individuals aged 16 years and over are permitted to participate in any motorsport related activity, including as a driver or passenger.
(b) All drivers must hold a valid provisional driver licence (minimum red P plates) or higher.
(c) If a participant is under 18 years of age, they must have the consent of a parent or legal guardian.
(d) Luddenham Raceway may rely on information provided by participants in determining eligibility.
(e) Any person who does not meet these requirements will not be permitted to participate.
(f) Failure to meet eligibility requirements, including licence, age, approval status, or identity verification, will result in refusal of entry or participation with no refund, credit, or transfer.13.3 Fixed Date Nature of Events
All Events are conducted on fixed dates and are not recurring services.
By purchasing a ticket or entry, you acknowledge that the Event is date specific and cannot be rescheduled, deferred, or substituted for another date, service, or product.13.4 No Transfers, Credits or Rescheduling
To the maximum extent permitted by law:
(a) tickets and entries are non transferable unless expressly approved in writing
(b) tickets and entries cannot be transferred to another date or Event
(c) tickets and entries cannot be exchanged, credited, or converted into any other product or service13.5 No Change of Mind
To the maximum extent permitted by law, no refunds, credits, or exchanges will be provided for:
(a) change of mind
(b) personal circumstances or scheduling conflicts
(c) failure to attend
(d) inability to participate13.6 Participant Responsibility and Approval Based Entry

they will not be permitted to participate and will not be entitled to any refund, credit, or transfer.13.7 Event Changes, Postponement or Cancellation
Luddenham Raceway reserves the right to modify, postpone, cancel, interrupt, or alter an Event at any time due to factors including but not limited to weather, safety concerns, operational requirements, low participation, or circumstances beyond its control.
Events may be shortened, reformatted, or stopped early.
Participants are not entitled to a refund solely due to changes, delays, interruptions, or modified formats.
Where required under applicable law, Luddenham Raceway may provide an appropriate remedy.13.8 Ticket Holder and Acceptance of Terms
(a) Only the named ticket holder is permitted to redeem, enter, and participate in the Event unless otherwise approved in writing.
(b) By purchasing or using a ticket, all participants and attendees, whether participating or spectating, acknowledge and agree that:
– they are bound by these Terms
– they are bound by Luddenham Raceway’s Conditions of Entry
– they have reviewed or had the opportunity to review the Waiver and Indemnity Agreement available at https://luddenhamraceway.com/legal and via https://kiosk.bmileisure.com/luddenham/register
– they agree to be bound by the terms of that Waiver and Indemnity Agreement to the maximum extent permitted by law
(c) All drivers must complete any required waiver or registration process prior to participating in any driving activity. Failure to do so will result in refusal of participation with no refund.
(d) Failure to comply with any applicable terms, rules, safety requirements, or directions from staff or officials may result in refusal of entry or removal with no refund, credit, or compensation.13.9 Acknowledgement of Risk
(a) Motorsport activities are inherently dangerous and involve significant risks, including but not limited to serious injury, permanent disability, or death.
(b) By attending or participating in any Event, whether as a driver, passenger, or spectator, each person voluntarily assumes all risks associated with their presence at the venue and participation in the Event.
(c) Risks may arise from, including but not limited to:
– vehicle collisions
– mechanical failure
– track conditions
– actions of other participants or attendees
– environmental and weather conditions
(d) This clause operates in conjunction with, and does not limit, the Waiver and Indemnity Agreement referred to in clause 13.8.13.10 Prize Money and Competitions
(a) Where any prize is offered, including but not limited to cash, vouchers, goods, services or third party supplied items (“Prize”), the awarding, allocation, and determination of such Prize is at the sole and absolute discretion of Luddenham Raceway, event organisers, and judges.
(b) Judging may be based on criteria determined by the organisers, including but not limited to performance, skill, style, presentation, conduct, or any other factors considered relevant, and may be applied or varied at their discretion.
(c) All decisions are final and binding. No correspondence, dispute, or appeal will be entered into.
(d) Entry into an Event does not guarantee the receipt of any Prize.13.11 Competition Conditions and Outcomes
(a) Luddenham Raceway reserves the right to determine outcomes in all circumstances, including but not limited to:
– ties or equal scoring
– incomplete runs or sessions
– mechanical failure
– weather interruptions
– red flags or safety stoppages
– reduced or modified competition formats
(b) Results may be adjusted, finalised, or determined at the discretion of the organisers where the Event cannot proceed as originally planned.
(c) Participants must be present at the Event at the time and place designated for prize announcements to claim a Prize, unless otherwise approved.13.12 Prize Conditions
(a) Prizes are not transferable, exchangeable, or redeemable for cash unless expressly stated.
(b) Luddenham Raceway may substitute any Prize with another item of equal or lesser value where required.
(c) Where a Prize is supplied by a third party, Luddenham Raceway is not responsible for its provision, quality, or delivery, to the extent permitted by law.
(d) Any taxes, duties, or expenses associated with a Prize are the sole responsibility of the recipient.13.13 Conduct, Disqualification and Forfeiture
(a) Luddenham Raceway may disqualify any participant at any time in connection with the Event where they:
– breach these Terms
– fail to follow directions from staff or officials
– fail to comply with safety requirements
– act in an unsafe or unsportsmanlike manner
– damage property or endanger others
– bring the Event into disrepute
(b) Where disqualified:
– results may be voided
– any Prize may be withheld, revoked, or required to be returned13.14 Removal and No Refunds
Any person removed, ejected, or refused entry at Luddenham Raceway’s reasonable discretion for breach of these Terms or failure to comply with directions:
(a) is not entitled to any refund, credit, or compensation
(b) forfeits any right to participate
(c) forfeits any entitlement to any Prize13.15 Third Party Collaborations
Where an Event is conducted with a third party:
(a) additional terms may apply
(b) participants must comply with directions from both Luddenham Raceway and the third party13.16 Ticket Misuse and Resale
Tickets must not be resold, transferred for value, or used in promotions, raffles, or commercial packages without prior written consent.
Any breach may result in cancellation without refund and refusal of entry.13.17 Compliance with Law
Nothing in this section excludes, restricts, or modifies any rights under the Australian Consumer Law or any other applicable legislation.
